A judge has ruled against an approval from Metro Council for affordable housing to be built in Prospect.

Per court documents, the judge ruled that Metro council did not "analyze whether the development would comport with the 2040 comprehensive plan, which was referenced multiple times in the Land Development Code for Jefferson County."

The apartments would be located between River Road and U.S. Highway 42.

This is not the first time this development has been halted either.

Back in 2017, Metro Louisville's planning commission approved the housing plans, but it was then rejected by Metro Council.

While this ruling is final, LDG Development can appeal the ruling with new evidence.

This new evidence must be composed of elements that consider the 2040 comprehensive plan and meet the standards.

Although the judge did state that should Metro Council not be considering the 2040 plan, then must rewrite Land Development Code. That would include addressing sidewalks, bike lanes, employment centers and other factors.

The judge closed her ruling by stating that "mere lip service to the need for affordable housing" is not sufficient.
